Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Lingupi mobile application ("Lingupi" or the "App") and the website lingupi.com (together, the "Services") provided by Creatoks LLC ("Creatoks", "we", "us", or "our"). By using the Services, you agree to these Terms.

2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Lingupi. If you are under the age of majority where you live, you must have permission from a parent or guardian.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial language learning. You may not copy, modify, distribute, sell, or reverse engineer the App or its content except as permitted by law.
4. Content
Stories, exercises, artwork, audio, trademarks, and other materials in Lingupi are owned by Creatoks or its licensors and are protected by copyright and other laws. You receive no ownership rights to the content.
5. Free content and Lingupi Premium
Chapter 1 of each learning path is available without a subscription. Additional chapters require Lingupi Premium, an auto-renewing subscription sold through the Apple App Store or Google Play Store.
Subscription products (identifiers may vary by store configuration):
- lingupi_annual — billed annually after any applicable free trial;
- lingupi_weekly — billed weekly after any applicable free trial.
Prices, trial length, and local currency amounts are displayed in the App at the time of purchase and are set by the applicable store in your region.
6. Auto-renewal and billing (Apple & Google)
Lingupi Premium is an auto-renewing subscription. Unless you turn off auto-renew at least 24 hours before the end of the current period, your subscription renews automatically and your account is charged within 24 hours before the period ends.
Apple App Store: Payment is charged to your Apple ID account at confirmation of purchase. Manage or cancel in your Apple Account Settings after purchase. Any unused portion of a free trial is forfeited when you purchase a subscription.
Google Play: Payment is charged to your Google Play account at confirmation of purchase. Manage or cancel under Google Play → Payments & subscriptions after purchase. Any unused portion of a free trial is forfeited when you purchase a subscription.
Refunds are handled by Apple or Google according to their policies. Creatoks does not process store refunds directly.
7. Restore purchases
If you reinstall Lingupi or use another device signed into the same store account, use the "Restore" option in the App to recover an active subscription tied to that account.
8. Acceptable use
You agree not to:
- Use the Services unlawfully or to harm others;
- Attempt to bypass subscription or content access controls;
- Interfere with or disrupt the Services or servers;
- Use automated means to scrape or extract content at scale.
9. Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Lingupi is an educational tool and does not guarantee fluency, exam results, or professional outcomes.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATOKS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO CREATOKS FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
11. Indemnification
You agree to indemnify and hold Creatoks harmless from claims arising out of your misuse of the Services or violation of these Terms.
12. Changes
We may modify the Services or these Terms. We will post updated Terms on this page with a new effective date. Continued use after changes become effective constitutes acceptance.
13. Termination
We may suspend or terminate access to the Services if you violate these Terms. You may stop using the Services at any time by uninstalling the App and canceling subscriptions through your store account.
14. Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law principles. Exclusive venue for disputes shall be in courts located in New Mexico, except that consumers in the EU or other jurisdictions may have mandatory local rights.
